I think you might be trying to read a little too much into marketing.
Besides, given the choice between a place whose logo has a fish that smiles while it's boiled alive, or a place whose logo is of a fish writhing in pain while it's boiled alive, I imagine most people would feel a lot less uncomfortable about the former.
